Consumer information about the statutory right of withdrawal for digital services from Emoria, in particular for subscriptions and storage plans as well as paid virtual memorial candles, including notes on the early expiry of the right of withdrawal, on compensation for value, on the consequences of withdrawal as well as the complete model withdrawal notice and the model withdrawal form pursuant to Annex 1 and Annex 2 to Art. 246a EGBGB.
If you, as a consumer, conclude a contract for paid digital services with Emoria, you generally have a statutory right of withdrawal of 14 days, unless a statutory exception applies or the right of withdrawal expires early.
For digital services and digital content, the withdrawal period generally begins with conclusion of the contract.
For recurring subscriptions and storage plans, the contract details communicated to you at checkout or in the order confirmation apply additionally.
Paid memorial candles are activated digitally immediately after successful payment. To purchase a paid memorial candle, you must expressly consent at checkout that Emoria begins providing the candle immediately and confirm that you thereby lose your right of withdrawal for this digital service (Section 356(5) BGB).
For subscriptions and storage plans, withdrawal generally remains possible. If the booked plan is activated at your request during the withdrawal period, we charge only the pro-rata amount for the time until withdrawal. You do not pay the full period, but only the part of the subscription that has already been made available.
After withdrawal or termination of a subscription, you have 30 days to export or delete excess media. After that, Emoria may remove excess media (oldest first) until the Free plan limit is met; memorial pages as such remain.
To exercise your right of withdrawal, you must inform Emoria by means of a clear declaration of your decision. An informal email to the contact address below is sufficient.

If an effective withdrawal exists and the right of withdrawal has not already expired, Emoria will reimburse the affected payments without undue delay and at the latest within 14 days of receipt of your withdrawal using the same means of payment that you used for the original transaction, unless something else has been agreed.
For paid memorial candles, the right of withdrawal may expire upon activation after your confirmation at checkout. For subscriptions and storage plans, a pro-rata amount for the time already made available may be deducted in the event of an effective withdrawal, insofar as this is legally permissible.

Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract.
To exercise your right of withdrawal, you must inform us (lead.online GmbH, Baierbrunner Straße 3, 81379 München, Deutschland, email: hello@emoria.app) by means of a clear declaration (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, which is, however, not mandatory.
To meet the withdrawal deadline, it is sufficient that you send the notice of exercising the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal: If you withdraw from this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs arising from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received the notice of your withdrawal from this contract. For this reimbursement, we use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.
Expiry of the right of withdrawal: Your right of withdrawal expires early in the case of a contract for the supply of digital content not on a tangible medium or for digital services if we have begun performance of the contract after you have expressly consented to us beginning performance of the contract before expiry of the withdrawal period and you have confirmed your knowledge that, by giving your consent at the start of performance of the contract, you lose your right of withdrawal (Section 356(5) BGB).
For subscriptions and storage plans, compensation for value simply means: if the booked plan was activated at your request during the withdrawal period and you withdraw afterwards, you pay only the pro-rata amount for the time until withdrawal.
The pro-rata amount is calculated to the day on the basis of the monthly or annual price actually booked.
After an effective withdrawal or regular termination of a paid plan, you have 30 days to export or delete excess media (above the Free plan limit). After expiry of this period, we reserve the right to automatically remove excess media (oldest first) until the Free plan limit is met. The respective memorial pages as such remain fully intact.
